Special eligibility

VA medical benefits and HSA eligibility

Apply the special rules for Veterans Affairs medical care, service-connected treatment, and the rolling three-month lookback.

HSA rule
Receiving VA medical benefits can affect HSA eligibility for the following three months, while care for a service-connected disability is disregarded under the statutory exception.

Track date and purpose of care

Keep the date of each VA service and documentation showing whether it related to a service-connected disability. The rule focuses on receipt of medical benefits, not merely enrollment in the VA health system.

Map the lookback to monthly eligibility

Apply the rolling three-month rule against the first day of each prospective HSA month. If no exception applies, VA care can remove contribution eligibility even while the veteran remains enrolled in an HSA-qualified HDHP.

Example and common mistake

A veteran receives non-service-connected treatment and keeps contributing as though HDHP enrollment were the only test. That can overstate eligible months. The mistake is treating all VA care alike without documenting the statutory exception.

Record the type and date of VA care

Maintain a treatment log showing the date, facility, and whether the care was for a service-connected disability. The statutory treatment of VA benefits depends on those facts, not merely on veteran status. Compare each treatment date with the applicable three-month lookback before treating later months as eligible for HSA contributions.

Do not infer the classification from an appointment description. Use VA benefit records or obtain confirmation when the service-connected status is uncertain. Also test all other eligibility conditions independently: HDHP enrollment, Medicare, dependency, and other reimbursement coverage remain relevant even when the VA exception applies.

Questions to resolve

  • Was the care for a service-connected disability?
  • Which three-month lookback period follows the treatment date?
  • Are the person's other HSA eligibility conditions independently satisfied?
